These Terms and Conditions govern the use of all Alltix websites, applications, services, and platforms.

These Terms and Conditions govern the use of all Alltix websites, applications, services, domains, subdomains, including alltix.co, app.alltix.co, and any other platform, portal, or system operated by Alltix LLC, a Wyoming limited liability company ("Alltix", "we", "our", "us").

By using the Alltix platform as an event host, organizer, attendee, purchaser, scanner, contractor, or otherwise, you agree to these Terms in full. If you do not accept these Terms, do not use the platform.

1. Platform Scope and Role

Alltix provides ticketing, event-access software, payment connectivity, on-site hardware solutions, and related digital services.

Alltix is not the Merchant of Record. Every event organizer who sells tickets using Alltix is the Merchant of Record for their own transactions.

Organizers receive direct payouts from the connected payment processor unless contractually modified in writing.

2. Users Covered

These Terms apply to:

  • Event organizers, promoters, or venues using Alltix to sell or distribute tickets
  • Attendees and customers purchasing tickets through Alltix
  • Individuals interacting with kiosks, scanners, NFC devices, or Alltix-powered hardware

3. Accounts and Eligibility

To create or operate an organizer account you must:

  • Be 18 or older
  • Provide accurate registration information
  • Maintain the security of your login credentials
  • Provide updated information when details change

Alltix may suspend or terminate access for breach, fraud, or misuse.

4. Payments, Processing, and Payouts

  • Organizers connect their own merchant accounts to accept payments.
  • All payouts flow directly to the organizer through the payment processor unless separately contracted.
  • All refunds, disputes, chargebacks, or failed transactions are the responsibility of the event organizer, not Alltix.
  • Attendees understand that the event organizer, not Alltix, is the responsible party for financial claims.

5. Ticket Fulfillment and Communication

Alltix may issue confirmations, digital tickets, QR/NFC credentials, SMS/email notifications, and transactional receipts on behalf of organizers.

Delivery issues may occur due to mailbox filtering, carrier restrictions, incorrect entry, or system delays. These are not grounds for liability.

6. Refunds and Disputes

All refund policies are determined solely by the event organizer. Alltix does not issue refunds except when explicitly stated in a written agreement.

Any dispute regarding event quality, cancellation, seating, experience, or refunds must be handled directly with the event organizer.

7. Data Ownership and Use

Attendee personal data from ticket sales belongs to the event organizer. Alltix may store, process, and transmit data only for operational purposes including ticket delivery, scanning, analytics, fraud prevention, and customer support.

We may anonymize and aggregate non-identifiable data for system improvements and reporting.

Organizers must maintain compliance with applicable privacy laws in their jurisdiction.

8. Hardware, Kiosks, NFC Devices, Wristbands

If organizers rent or purchase hardware from Alltix (kiosks, scanners, printers, NFC wristbands):

  • Equipment remains property of Alltix unless sold
  • Organizers are financially responsible for any loss, damage, theft, or misuse
  • Replacement charges, repair fees, consumables, and shipping costs may apply

Alltix is not liable for operational delays caused by user misuse, network failure, incorrect setup, environmental issues, or venue interference.

9. Fees and Pricing

Pricing, transaction fees, service fees, and hardware rental rates vary per contract and will be defined in writing when onboarding.

Use of the platform constitutes acceptance of any posted or contract-defined rates.

10. Service Availability

Alltix provides services on a best-effort basis. We do not guarantee uninterrupted uptime, ticket delivery, network performance, or access availability.

Support response time is generally within hours or faster, but not guaranteed.

11. Restrictions

Users may not:

  • Resell access to Alltix without authorization
  • Attempt to manipulate or bypass ticket validation systems
  • Process payments for another merchant's event under your account
  • Interfere with platform integrity or security measures

Breach may result in account termination, fee penalties, and legal action.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Alltix is not liable for indirect, incidental, consequential, punitive, or special damages
  • Our total liability shall not exceed the total amount of service fees paid directly to Alltix in the 90 days preceding the claim
  • Event organizers assume responsibility for attendee satisfaction, event execution, safety, and financial resolution

Users knowingly waive claims beyond this limit.

13. Indemnification

Organizers and users agree to defend and indemnify Alltix from claims arising from:

  • Event problems, cancellations, disputes, or attendee issues
  • Payment failures, chargebacks, or financial loss
  • Misuse of hardware, scanning devices, or venue interference

14. Modification of Terms

Alltix may update these Terms at any time. Continued platform use confirms acceptance of the updated version.

15. Governing Law

Any dispute, claim, or proceeding relating to the use of Alltix shall be handled exclusively in Kings County, New York, under New York State law.

16. Severability

If one section is held invalid, remaining clauses remain enforceable. A valid replacement clause closest in intent will apply.
